Municipal planning laws, municipal zoning bylaws, neighborhood Homeowners Association (HOA) rules, and regional building codes vary significantly across states, counties, and cities regarding the placement, permanent foundation, and habitable conversion of shipping containers.

4. Site Access, Ground Preparation & Delivery Liability

Shipping container delivery vehicles (including 40ft tilt-bed trailers and heavy crane/HIAB trucks) require adequate clearance and solid ground conditions:

• Site Accessibility: The customer must ensure clear access paths free of low-hanging electrical powerlines, tree branches, soft terrain, mud, steep inclines, and narrow gate openings.
• Ground Subsidence: Containers must be placed on firm, level, well-drained ground supported by concrete piers, gravel pads, or hardwood timber dunnage. We are not liable for container shifting, door misalignment, or settling caused by inadequate site foundation preparation.
• Unsuccessful Delivery: If delivery cannot be completed due to inaccessible site conditions, overhead hazards, or soft ground, additional attempted delivery, standby, or return freight charges will apply.

Shipping containers modified into habitable spaces (e.g., offices, studios, workshops) or recreational features (e.g., Container Pools) require specialized engineering, electrical hookups, and professional plumbing.

6. Reefer & Temperature Control Equipment

While our Reefer Shipping Containers are thoroughly tested and inspected prior to delivery, maintaining continuous temperature regulation requires proper operating conditions:

• Power Supply Requirements: The buyer must ensure stable, dedicated 3-phase electrical power matching the refrigeration unit specifications.
• Perishable Goods Liability: We are not liable for spoilage or loss of stored perishable products, food inventory, or pharmaceuticals caused by external electrical power outages, improper temperature setting, or failure to perform routine maintenance.

To the maximum extent permitted by applicable law, in no event shall Shipping Container Transport LTD, its directors, employees, affiliates, or transport partners be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of revenue, profits, data, inventory spoilage, business interruption, or personal property damage—arising from or in connection with the purchase, delivery, placement, or use of any shipping container or conversion product.
