1. Agreement to Terms & Legal Capacity

These Terms and Conditions constitute a legally binding agreement between you (whether individually or on behalf of an entity, "Buyer", "Customer", or "You") and Shipping Container Transport LTD ("Company", "We", "Us", or "Our"), concerning your access to our website, formal quotations, sales orders, and the purchase of standard shipping containers, High Cube containers, office containers, reefer units, container pools, and custom modifications.

By placing an order, accepting a quote, signing an invoice, or utilizing our website, you expressly acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using this website and purchasing our products.

2. Product Specifications & Condition Grading

We supply new, one-trip, and used shipping containers graded in accordance with standard maritime industry classifications:

• New / One-Trip Containers: Manufactured overseas, shipped with a single dry cargo load to the US, and delivered in pristine structural and cosmetic condition (may exhibit minor transit tire marks).
• Used (Wind & Water Tight / WWT): Structurally sound units certified to keep interior cargo dry and secure. Used containers will exhibit cosmetic wear, surface scratches, minor dents, and varied original shipping line colors/logos.
• Dimensional Standard: All containers conform to ISO standards (ISO 668 and ISO 1496/1). High Cube containers provide 9ft 6in exterior vertical clearance compared to standard 8ft 6in units.

3. Orders, Quotations, Pricing & Payment Terms

Quotations & Acceptance: Quotations issued by Shipping Container Transport LTD remain valid for the period stated on the quote (typically 7–14 calendar days). A binding sales contract is formed upon customer invoice approval and receipt of payment.

Payment Methods: We accept Wire Transfer (ACH), Certified Business Checks, Major Credit Cards (Visa, MasterCard, American Express, Discover), and approved Commercial Financing.

Sales Tax: Applicable destination-based state, county, and local sales tax will be clearly itemized on your invoice in accordance with our Sales Tax Policy unless a valid tax exemption certificate is provided prior to payment.

4. Delivery, Title Transfer & Risk of Loss

Title & Ownership: Legal title to the shipping container transfers to the Buyer only upon receipt of 100% cleared funds.

Risk of Loss: The risk of loss or physical damage during transit is borne by Shipping Container Transport LTD and its insured commercial transport carriers. Risk of loss transfers entirely to the Buyer at the exact moment the container is safely offloaded onto the Buyer's property and the delivery receipt / Bill of Lading (BOL) is signed.

5. Buyer Responsibilities: Zoning, Permits & Site Access

Permits & Local Compliance: The Buyer is exclusively responsible for obtaining all municipal zoning clearances, building permits, HOA permissions, setback approvals, and engineering foundations prior to delivery.

6. Custom Modifications & Container Pools

Custom container orders—including bespoke Container Pools, partitioned Office Containers, structural cutouts, roll-up doors, electrical installations, and specialized exterior paint finishes—are fabricated in strict accordance with approved blueprints and CAD drawings.

• Blueprint Sign-Off: Fabrication commences only after the Buyer approves the technical modification drawings.
• Non-Refundable Custom Deposits: Once steel cutting, structural welding, or specialized material procurement has begun, customization deposit fees are non-refundable.

7. Product Quality, Warranties & Return Policy

All containers are backed by our comprehensive Product Quality Guarantee and Refund & Returns Policy:

• 30-Day Return Window: Customers may initiate a return within 30 days of delivery in accordance with our return guidelines with $0 restocking fees.
• Defective Upon Arrival: If a container arrives with structural defects or water leaks, we provide free on-site mobile repair or replacement at zero cost to you.

8. Limitation of Liability & Indemnification

To the fullest extent permitted by law, Shipping Container Transport LTD, its officers, employees, agents, and carrier partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of business profits, lost inventory, cargo spoilage in reefer units, or business downtime).

The Buyer agrees to indemnify, defend, and hold harmless Shipping Container Transport LTD against any third-party claims, fines, or property damage arising out of the Buyer's non-compliance with local zoning laws, improper site preparation, or unauthorized structural modifications.

9. Intellectual Property & Website Use

All content, text, 3D renderings, trademarks, logos, diagrams, and code appearing on this website are the proprietary property of Shipping Container Transport LTD. You are granted a limited license for personal and commercial container purchasing inquiries only. Unauthorized copying, scraping, reproduction, or republication is strictly prohibited.

10. Governing Law, Dispute Resolution & Jurisdiction

These Terms and Conditions, sales agreements, and all transactions shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.

Any legal suit, action, or proceeding arising out of or related to these Terms or our products shall be instituted exclusively in the state or federal courts located in Hillsborough County, Florida. Both parties consent to personal jurisdiction and venue in such courts.
